Terms of Use
Effective Date: June 17, 2025
Last Updated: June 20, 2026
My Doctor Companion, Inc. (doing business as “My Doctor Friend,” referred to below as “MDF,” “we,” “us,” or “our”) provides educational health information. These Terms form a legally binding agreement between you and MDF governing all use of our websites, iOS app, and related services (collectively, the “Services”). By using the Services you agree to these Terms and to our Privacy Notice. If you do not agree, do not use the Services.
1. SCOPE AND ELIGIBILITY
- You confirm you are at least 13 years old, located in the United States, and capable of entering a contract.
- The iOS app is rated 17 plus in the Apple App Store and is not directed to children under 13.
- If you download the iOS app from Apple, the Apple Licensed Application End User License Agreement (“LAEULA”) is incorporated by reference. If these Terms conflict with the LAEULA, the LAEULA controls.
- MDF does not provide medical advice, diagnosis, or treatment. Always consult a licensed clinician. In an emergency dial 911.
2. IMPORTANT DISCLAIMERS
- Content in the Services is for informational purposes only and may include answers generated by artificial-intelligence models. AI content can contain errors and is not a substitute for professional care.
- No doctor–patient relationship is created.
- MDF does not endorse any specific provider, product, or treatment. Your reliance on any information is at your own risk.
- The Services are not designed for children under 13 or for paediatric symptom evaluation.
- Sexually explicit medical content may appear. Do not use the Services if you find such content offensive.
- Community content is submitted by other users. It reflects their personal experiences and opinions, is not reviewed, verified, or endorsed by MDF, and is not professional medical advice. No clinician-patient relationship is created through the Community. Where a verified badge is shown, it indicates only that MDF confirmed the member’s credential. It is not an endorsement of any post.
3. USER ACCOUNTS
- Certain features require an account. You must provide accurate information and keep credentials secure.
- You may delete your account at any time from the in-app Settings screen; deletion triggers the data-removal workflow described in our Privacy Notice.
- MDF may suspend or terminate your access for any violation of these Terms.
- Some Community features require a verified email. Community-level actions such as suspension, ban, or restriction are in addition to MDF’s right to suspend or terminate your account under these Terms.
4. LICENSE AND ACCEPTABLE USE
- MDF grants you a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes.
- You agree not to upload or transmit content that infringes others' rights, is unlawful, abusive, or disrupts the Services.
Prohibited Automated Access and Data Collection
- No bots or automated collection. You may not use bots, scrapers, crawlers, spiders, or similar automated tools to access, query, copy, or store any part of the Services or Content.
- No bulk access outside our API. Bulk or systematic access (including exporting, mirroring, or indexing) is only allowed via our official API under a separate written agreement. All other automated collection is prohibited.
- No account workarounds. Creating or using accounts (including paid accounts) for the purpose of scraping, data harvesting, benchmarking, or building competitive datasets is forbidden and will result in immediate termination.
- No circumvention. Do not bypass or attempt to bypass rate limits, CAPTCHAs, authentication, access controls, or other security measures.
- No downstream competitive use. You may not sell, license, publish, or otherwise use any data, content, or outputs obtained from the Services to build, train, improve, or operate competing services, datasets, models, or products, except as expressly permitted in a separate written agreement.
- Reservation of rights and remedies. MDF reserves the right to throttle, suspend, or terminate access; block IP addresses; and pursue all available legal remedies (including injunctive relief, damages, and attorney fees) for violations of these restrictions.
Additional Restrictions
- You may not reverse-engineer, decompile, disassemble, or create derivative works from the Services.
- You may not frame, mirror, or present the Services as part of another service or website.
- You may not remove, alter, or obscure any proprietary notices, trademarks, or branding.
5. USER-GENERATED CONTENT AND MODERATION
Your content and license
- You retain ownership of content you submit and grant MDF a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, adapt, and distribute it for operating and promoting the Services, including displaying it to other members of a Community. This license ends when you delete the content or your account, except for copies in routine backups until they are overwritten and records in our moderation audit log retained for safety. Other members may have seen, copied, or responded to your content while it was posted, and MDF cannot retrieve those copies.
- User-Created Tools and Plugins are governed by Section 6, which controls over this Section to the extent of any conflict.
Community rules
There is no tolerance for objectionable content or abusive behavior in Communities. When you participate in a Community, you agree not to:
- harass, bully, threaten, or intimidate others, or post hateful content;
- impersonate any person or organization, including MDF staff or a healthcare professional, or present yourself as a clinician you are not;
- post another person’s private or identifying information;
- post spam, advertising, or solicitations, or manipulate voting, including through bots or multiple accounts (see Section 4);
- post content promoting dangerous health practices likely to cause harm, such as specific dangerous dosing instructions or claims presented as guaranteed cures;
- post unlawful content or content that infringes the rights of others.
Pseudonyms
- You participate under a pseudonym you choose when you first join a Community. Your pseudonym is permanent and may not imply clinical authority or impersonate another person or MDF.
Moderation, reporting, and blocking
- MDF and community moderators may, at their discretion and without prior notice, remove, lock, or pin content and suspend, ban, restrict, or limit the visibility of accounts that violate these Terms. MDF provides in-app tools to report content and to block other members. MDF may, but is not obligated to, monitor Community content, and moderation is not guaranteed to be complete or consistent.
Communities you create or moderate
- If you create or moderate a Community, you are responsible for setting and enforcing its rules consistent with these Terms. MDF may remove a Community or a moderator at its discretion.
6. USER-CREATED TOOLS AND PLUGINS
The Services may allow you to create, configure, build, submit, or share custom tools, plugins, prompts, agents, workflows, or similar functionality (each, a “Tool,” and collectively, “Tools” or “plugins”). This Section applies in addition to Section 5 and governs all Tools. Because a Tool may be hosted, run, modified, or made available to other users within the Services, the terms below are intended to protect MDF’s ability to host, run, modify, re-version, and remove Tools without interference. To the extent this Section conflicts with Section 5, this Section controls for Tools.
Your grant of rights to MDF
- Ownership and license. You retain ownership of the Tools you create. By creating, submitting, or sharing a Tool through the Services, you grant MDF a non-exclusive, perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to host, store, reproduce, modify, adapt, create derivative works of, translate, publish, publicly display and perform, distribute, run, and otherwise exploit the Tool and its source code, in whole or in part, in any media now known or later developed, for any purpose, including commercial purposes. You remain free to use, modify, and license your Tool for any purpose.
- No conflicting claims; non-assertion. You covenant not to assert, and waive any right to assert, any intellectual property, ownership, moral, or other claim against MDF or any user that would interfere with the rights granted above. You agree that MDF may review, modify, suspend, re-version, or remove any Tool at its sole discretion, with no obligation to publish, retain, or attribute it.
- Waiver of moral rights. To the extent permitted by law, you waive, and agree not to assert, any moral rights or rights of attribution or integrity in the Tool.
- Survival. The license granted in this Section survives removal of a Tool to the extent necessary for existing copies, backups, derivative works, and legal compliance.
Your responsibilities for Tools
- Your representations. You represent and warrant that: (a) you created the Tool yourself or have all rights necessary to grant the rights above; (b) the Tool does not infringe or misappropriate any third party’s intellectual property or other rights; (c) the Tool contains no malware and no personal or health information of any other person; and (d) the Tool and your submission comply with all applicable laws and these Terms.
- No medical advice; no provider relationship. Tools are informational only, are not medical advice, and do not create a doctor-patient or other provider-patient relationship. Submitting a Tool does not make you a healthcare provider, and you are solely responsible for the content and behavior of your Tool.
- Indemnification. In addition to Section 13, you will indemnify and hold harmless MDF and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your Tool or your breach of these Terms.
Rewards and usage data
- Reserved rewards (no obligation). MDF may, in its sole discretion, introduce programs that recognize or compensate creators of Tools, governed by separate terms. Submitting a Tool does not entitle you to any payment, and no compensation is owed unless and until such a program expressly provides for it.
- Usage data. MDF may collect, use, and display usage and performance data relating to Tools (for example, how often a Tool is run), including for product, safety, and any future recognition or rewards purposes, as further described in our Privacy Notice.
7. PAYMENTS AND SUBSCRIPTIONS
- iOS in-app subscriptions are processed by Apple and billed to your Apple ID. Subscriptions renew automatically unless cancelled in Apple ID settings at least 24 hours before the end of the current period.
- Web subscriptions are processed by Stripe under separate Stripe terms.
- Fees are non-refundable except where required by law or Apple's refund policies.
8. THIRD-PARTY SERVICES
- Links to telehealth, lab testing, or other third-party services are provided for convenience. MDF does not endorse or control them. Their terms and privacy practices apply once you leave our domain.
9. HEALTHKIT AND SENSOR DATA (FUTURE USE)
- MDF does not access Apple HealthKit or wearable-sensor data at launch. If HealthKit integration is added later, MDF will not use HealthKit data for advertising, marketing, or data-mining.
10. INTELLECTUAL PROPERTY
- All content, software, trademarks, and logos in the Services are owned by MDF or its licensors and protected by U.S. and international law.
- You may not use MDF trademarks without written permission.
11. COPYRIGHT COMPLAINTS
If you believe content in the Services infringes your copyright, notify our designated agent at legal@mydoctorfriend.ai with the following:
- your physical or electronic signature;
- identification of the copyrighted work you claim has been infringed;
- identification of the material you claim is infringing and its location in the Services;
- your contact information;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
MDF will remove infringing material, may offer a counter-notice process, and may terminate the accounts of repeat infringers.
12. MANAGEMENT OF YOUR INFORMATION
- You are responsible for any information you provide and warrant you have the right to provide it.
- See our Privacy Notice for details on collection, use, and deletion of your data.
13. DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY
- The Services are provided “as is” and “as available.” MDF disclaims all warranties, express or implied.
- MDF and its affiliates will not be liable for indirect or consequential damages; total liability will not exceed one hundred U.S. dollars (USD $100). These limits do not apply to liability resulting from gross negligence or intentional misconduct.
- You agree to indemnify and hold harmless MDF from claims arising out of your use of the Services or any violation of these Terms.
- Community content is created by users, not by MDF. MDF provides an interactive service and is not responsible or liable for content posted by other users, which reflects the views of those users and not MDF. MDF is not liable for interactions between users. Your use of, and reliance on, content posted by other users is at your own risk.
14. ENFORCEMENT AND TERMINATION
- MDF may investigate suspected violations and may suspend or terminate access, remove content, or report matters to law-enforcement.
- Certain sections of these Terms (including intellectual-property, disclaimers, limitation of liability, indemnity, and dispute resolution) survive termination.
15. DISPUTE RESOLUTION AND ARBITRATION
- Any dispute arising from these Terms or the Services will be resolved by binding arbitration under the Federal Arbitration Act, except claims that qualify for small-claims court or for injunctive relief regarding intellectual-property rights.
- Arbitration will be conducted in San Francisco, California, by a single arbitrator.
- You may opt out of this Arbitration Agreement within 30 days of first downloading the app by emailing legal@mydoctorfriend.ai with your name, address, and statement “I opt out of arbitration.”
- Claims must be brought only on an individual basis; class actions are waived.
- Both parties waive the right to a jury trial.
16. GOVERNING LAW; VENUE
- These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, and by the Federal Arbitration Act.
- Subject to the arbitration clause, any claim that must be litigated in court will be brought exclusively in the state or federal courts located in San Francisco County, California.
17. ELECTRONIC COMMUNICATIONS
- You consent to receive all notices electronically. Keep your email address current; notices sent to the last address you provided are deemed delivered.
18. FORCE MAJEURE
- MDF is not liable for failure to perform due to events beyond its reasonable control, including natural disasters, internet outages, or governmental actions.
19. SEVERABILITY; NO WAIVER
- If any provision is unenforceable, it will be modified to reflect the original intent while the remainder remains in effect.
- MDF's failure to enforce any right is not a waiver of that right on any other occasion.
20. ENTIRE AGREEMENT AND CHANGES
- These Terms and the Privacy Notice constitute the entire agreement and supersede all prior understandings.
- MDF may update these Terms. Material changes will be posted with a new effective date and highlighted through the Services, such as an in-app notice the next time you use the app. Continued use after changes constitutes acceptance.
